FAMLI: Colorado Paid Leave Guide
Colorado's Family and Medical Leave Insurance (FAMLI) program provides paid leave to eligible workers starting 2024.
What Is FAMLI?
FAMLI is a state-run insurance program that allows workers to take up to 12 weeks of paid leave per year for qualifying reasons, funded by small payroll contributions from employees and employers.
Who Qualifies?
- Worked 180 days for a covered employer
- Earned at least $2,500 in the base period
- Employed in Colorado
Qualifying Reasons
- Serious health condition — your own or an immediate family member's
- Bonding with a new child — birth, adoption, or foster placement
- Military exigency — qualifying need from a family member's military deployment
- Safe leave — domestic violence, stalking, sexual assault
Benefit Amounts
Benefits are calculated as a percentage of your average weekly wage:
- 90% of wages up to 50% of the state average weekly wage (SAWW)
- 50% of wages above that threshold
- Maximum: $1,100/week (2024 cap)
How to Apply
- Notify your employer at least 30 days in advance when possible
- File a claim at MyFAMLI+ (myfamliplus.colorado.gov)
- Upload supporting medical documentation
- Employer will be notified and must respond within 5 business days
- Benefits approved within 10 business days of complete application
Employee Protections
- Employer cannot retaliate for taking FAMLI leave
- Job must be held for leaves under 12 weeks
- Health insurance continues during leave
Contribution Rates (2024)
- Employee: 0.45% of wages
- Employer (10+ employees): 0.45% of wages
- Employer (<10 employees): optional
